§ 300.199 State administration.

This section requires each State receiving Part B funds to ensure its rules and policies conform to Part B's purposes, identify in writing any State-imposed requirements that exceed federal mandates, and minimize regulatory burden on LEAs and schools. Key requirements

  • Each State that receives funds under Part B of the Act must ensure that any State rules, regulations, and policies relating to this part conform to the purposes of this part
  • Identify in writing to LEAs located in the State and the Secretary any such rule, regulation, or policy as a State-imposed requirement that is not required by Part B of the Act and Federal regulations
  • Minimize the number of rules, regulations, and policies to which the LEAs and schools located in the State are subject under Part B of the Act
  • State rules, regulations, and policies under Part B of the Act must support and facilitate LEA and school-level system improvement designed to enable children with disabilities to meet the challenging State student academic achievement standards
