NC 1502-17 LEA Compliance
Plain English summary
This regulation establishes the process by which the SEA may reduce or withhold payments to an LEA found to be failing compliance with requirements under NC 1502-2 through NC 1502-14. LEAs receiving notice of such action must inform the public within their jurisdiction, and the SEA must take into account any adverse hearing decisions under NC 1504-1.12 through NC 1504-2.4. The regulation outlines enforcement mechanisms tied to LEA eligibility and funding.
Key requirements
- If the SEA, after reasonable notice and an opportunity for a hearing, finds that an LEA that has been determined to be eligible under this subpart is failing to comply with any requirement described in NC 1502-2 through NC 1502-14, the SEA must reduce or must not provide any further payments to the LEA until the SEA is satisfied that the LEA is complying with that requirement.
- Any LEA in receipt of a notice described in paragraph (a) must, by means of public notice, take the measures necessary to bring the pendency of an action pursuant to this section to the attention of the public within the jurisdiction of the agency.
- In carrying out its responsibilities under this section, each SEA must consider any decision resulting from a hearing held under NC 1504-1.12 through NC 1504-2.4 that is adverse to the LEA involved in the decision.
