NC 1502-11 Purchase of Instructional Materials

This regulation governs how Local Education Agencies (LEAs) must handle the purchase of accessible instructional materials, either by coordinating with NIMAC under the same conditions as the SEA, or by providing assurances to the SEA that accessible materials will be delivered to blind or print-disabled students in a timely manner. LEAs retain the option to opt out of NIMAC coordination but remain responsible for ensuring all students with disabilities receive accessible instructional materials regardless of format needs or NIMAC eligibility.
Key requirements
- An LEA that chooses to coordinate with NIMAC must acquire instructional materials in the same manner and subject to the same conditions as the SEA under NC 1501-14.3.
- If an LEA chooses not to coordinate with the NIMAC, the LEA must provide an assurance to the SEA that the LEA will provide instructional materials to blind persons or other persons with print disabilities in a timely manner.
- Nothing in this section relieves an LEA of its responsibility to ensure that children with disabilities who need instructional materials in accessible formats but are not included under the definition of blind or other persons with print disabilities in NC 1501-14.3(e)(1)(i) or who need materials that cannot be produced from NIMAS files, receive those instructional materials in a timely manner.
