NC 1502-7 Schoolwide Programs under Title I of the ESEA

This regulation allows LEAs to use IDEA Part B funds in Title I schoolwide programs, subject to a per-pupil proportional cap based on the number of children with disabilities participating. Even when funds are used this way, LEAs must still ensure children with disabilities receive services under a properly developed IEP and retain all rights guaranteed under Part B of the IDEA.
Key requirements
- The amount of IDEA Part B funds used in any schoolwide program may not exceed the per-pupil Part B amount multiplied by the number of children with disabilities participating in the schoolwide program.
- Funds used in schoolwide programs must be considered as Federal Part B funds for purposes of the calculations required by NC 1502-3(a)(2) and (a)(3).
- The funds may be used without regard to the requirements of NC 1502-3(a)(1).
- All other requirements of Part B of the IDEA must be met by an LEA using Part B funds in a schoolwide program.
- Children with disabilities in schoolwide program schools must receive services in accordance with a properly developed IEP.
- Children with disabilities in schoolwide program schools must be afforded all of the rights and services guaranteed to children with disabilities under the IDEA.
