NC 1501-7.2 Responsibility of State Education Agency

This regulation requires the State Education Agency (SEA) to ensure that children with disabilities placed in private schools or facilities by the LEA receive special education and related services in conformance with an IEP at no cost to parents. Key requirements

  • The SEA shall ensure the LEA's compliance with the following: a child with a disability who is placed in or referred to a private school or facility by the LEA is provided special education and related services in conformance with an IEP that meets the requirements of NC 1503-4 through NC 1503-5.2
  • Is provided special education and related services at no cost to the parents
  • Is provided an education that meets the standards that apply to education provided by the SEA and LEA including the requirements of these Policies, except for NC 1501-12.2(c)
  • Has all of the rights of a child with a disability who is served by a public agency
