Federal IDEA · 34 CFR Part 300 · Regulation

§ 300.810 Decrease in funds.

Plain English summary

This section establishes the formula for calculating state allocations under Section 619 of the Act when total available funds decrease below the prior fiscal year's allocation level. If funds remain above the fiscal year 1997 baseline, states receive their 1997 amount plus a proportional share of remaining funds. If funds fall to or below the 1997 baseline, states receive their 1997 allocation amount, subject to ratable reduction if necessary.

Key requirements

  • If the amount available for allocations to States under § 300.807 for a fiscal year is less than the amount allocated to the States under section 619 of the Act for the preceding fiscal year, those allocations are calculated as follows
  • If the amount available for allocations is greater than the amount allocated to the States for fiscal year 1997, each State is allocated the sum of the amount the State received under section 619 of the Act for fiscal year 1997 and an amount that bears the same relation to any remaining funds as the increase the State received under section 619 of the Act for the preceding fiscal year over fiscal year 1997 bears to the total of all such increases for all States
  • If the amount available for allocations is equal to or less than the amount allocated to the States for fiscal year 1997, each State is allocated the amount the State received for fiscal year 1997, ratably reduced, if necessary
