Federal IDEA · 34 CFR Part 300 · Regulation
§ 300.644 Annual report of children served—criteria for counting children.
Plain English summary
This section establishes the criteria by which a State Educational Agency (SEA) may count children with disabilities in its annual report of children served. Children may be counted if they are enrolled in a public agency-operated or supported school or program that provides them with special education and related services, special education alone when no related service is required, or, for parentally-placed private school children, if they are eligible under the Act and receive qualifying services meeting State standards.
Key requirements
- The SEA may include in its report children with disabilities who are enrolled in a school or program that is operated or supported by a public agency.
- The program must provide them with both special education and related services that meet State standards.
- The program may provide them only with special education, if a related service is not required, that meets State standards.
- In the case of children with disabilities enrolled by their parents in private schools, the SEA may count those children who are eligible under the Act and receive special education or related services or both that meet State standards under §§ 300.132 through 300.144.
